Section 100
WCSTA Membership
While we appreciate all Westchester Commons residents, simply owning or renting a house in the WC subdivision does not provide you with the privilege of using the tennis courts, pool, playground area or parking lot. Your household MUST be a Westchester Commons Swim & Tennis (WCSTA) member. Members pay a yearly “Recreational Level” fee to enjoy these amenities.
(a) All WCSTA members in good standing (i.e. all dues/fees paid) must have a current membership card with their name on the card and a working key fob with them at all times while on WCSTA property, including the pool area. From time-to-time, a lifeguard or WCSTA board member may perform a “key check” of any and all members on WCSTA property. If you do not have all required information then you will be asked to leave the property and return once you bring all of the required membership credentials.
(b) A member is not permitted to open the gate or hold the gate open for another WCSTA member or guest trying to enter the pool area, unless the person is a member of your household or your guest. We understand the temptation to “lend a land” to someone that has his/her “hands full” with pool toys, coolers, etc. However, it is a policy that EVERY member MUST use a working key fob to gain entrance into the pool area. No exceptions!!!!!!
If a WCSTA member is seen by a board member, a pool committee member, lifeguard or on the CCTV system assisting another member or guest with entrance into the pool area then that member will risk having their membership suspended for the entire pool season!!!
(c) All members must have a working key fob and a membership card on them at all times when on WCSTA property. The lifeguard, board members or a member of the Pool Committee will perform random membership checks. If you do not have your key fob and your membership card with your name on it then you (and any guests) will be asked to immediately leave the premises. You are welcome to return to the WCSTA property (pool/tennis courts/parking lot area) once you have retrieved these items.
(d) At no time shall a WCSTA member allow anyone (outside of their household) to use their assigned key fob(s) and/or membership card. Each member is responsible for their membership credentials and its usage.
Section 200
Guests Policy
(a) The number of guests allowed in the pool area will be limited to two (2) non-resident guests per household membership, unless previous arrangements have been made with the Pool Director. Violating this rule will result in all of your guests having to immediately leave the WCSTA property for the day. Additionally, the member will risk having their household membership being suspended for a period of time.
(b) Non-WCSTA members who live in the subdivision CANNOT be considered a guest of a WCSTA Member! If a WCSTA member does permit a Westchester Commons resident (non-member) into the pool area then the member will receive an immediate suspension of their membership for the entire pool season. No exceptions!
(c) All guests must arrive and depart with the member.
(d) It is the responsibility of the member to ensure that your guest understands the rules and policies while on WCSTA property. The WCSTA member will be held accountable for all actions of their guest(s).
(e) All guests on WCSTA property must be able to provide proper I.D. (photo/address verification) to confirm they do not reside in the Westchester Commons subdivision. At any time, a lifeguard or WCSTA board member may request this information.
SECTION 300
General Pool Rules
(a) No alcoholic beverages are allowed for anyone under the age of 21. Others please use discretion as this is a pool for all ages!
(b) As required by law, the use of tobacco products is permitted for ages 18 years and older.
(c) No smoking in the entrance way or in the pavilion area. Please provide your own cigarette disposal.
(d) Gum is not permitted in the pool area or in the pool.
(e) Cut-offs and/or improper swim wear are not allowed in the pool.
(f) At any time, the lifeguard has the authority to disallow balls, Frisbees, tubes, floats, etc.
(g) Lifeguards have the authority to disallow exuberant games when interfering with the enjoyment of the pool by others.
(h) All trash much be placed in the containers provided. Please recycle!
(i) No animals (pets) are allowed in the pool area.
(j) No PDA (Public Display of Affection) allowed as this is a family-friendly facility.
(k) The number one responsibility of the lifeguard(s) is member safety! Therefore, members and guests are not allowed to fraternize with the lifeguard(s) while on duty. The lifeguard(s) cannot take his/her attention away from members in the pool.
Section 400
Health & Safety
(a) All WCSTA gates to the pool and tennis courts should remain locked at all times.
(b) When a lifeguard is off duty, you swim at your own risk.
(c) Unattended solo swimming is prohibited.
(d) All WCSTA members and guests use the pool area and pool at his/her own risk and responsibility.
(e) No standing or diving on the lifeguard stand or on any of the WCSTA pool equipment (such as chairs or tables).
(f) No diving is permitted at any time.
(g) No running, pushing, jumping in on others, dunking or holding others under the water.
(h) Anyone caught climbing a fence on WCSTA property will be considered a trespasser and will be dealt with accordingly.
(i) No glass, bottles, chinaware or other breakable items are allowed in the pool area.
(j) All swimmers are required to shower before entering pool.
(k) Spitting and/or blowing the nose, etc., in the swimming pool shall be strictly prohibited.
(l) Persons having an infectious or communicable disease shall be excluded from using this pool. Additionally, persons with open blisters, rashes or open cuts will not be permitted within the pool area.
(m) All members and guests should wash their hands after using the restroom.
(n) Diapers are to be changed in the women’s restroom. At no time shall a diaper be changed on a table in the pool area, on a chair, or anywhere in the pool area. Doing so will risk your membership being suspended.
(o) Members and guests should always cover the pool furniture (chairs and lounges) with a towel when sitting or laying on the equipment.
(p) Gwinnett County requires that all lifeguards have a period of rest (10 minutes) during each hour. The lifeguard will call “Adult Swim” at the beginning of his/her break. At WCSTA, we provide a 15-minute break each hour so that the lifeguard can have his/her 10 minutes of rest. The additional five (5) minutes is used to check the chemicals in the pool and perform a bathroom check. During these breaks, please do not ask the lifeguard for assistance unless it is an emergency.
(q) Disorderly conduct (including cussing) will not be tolerated and is grounds for immediate suspension of your membership privileges for the entire pool season. The lifeguard and/or a WCSTA Board member has the authority to immediately remove anyone at any time for misbehavior, disorderly conduct or abusive language when on WCSTA property. Additionally, if the behavior is deemed as a serious violation then the lifeguard or a WCSTA board member has the authority to contact the police and report the incident to authorities.
(NOTE: Disorderly conduct is a crime against the public. If the activity offends other people's individual rights or interferes with other people's ability to live their lives in peace then the person can be charged with disorderly conduct. In the state of Georgia, if a person is found guilty of committing a crime against the public, he/she can be sentenced with community service, fines, or even jail time.)
Section 500
Children & Youth (under 18)
(a) All members are required to familiarize their children & youth with all pool rules.
(b) Parents assume responsibility for their children & youth at all times, even if the parent is not in the pool area. Additionally, parents or legal guardians are fully responsible for any damage caused by their child or youth.
(c) No child under the age of twelve (12) is allowed to swim without responsible adult supervision. Babysitters must be at least 16 years or older. A babysitter must either be a WCSTA member in good standing or live outside of the Westchester Commons subdivision (see Section 200:b).
(d) At no time can a parent or guardian ask the lifeguard to “watch” their child and then leave the pool area. If you have a child under 12 years of age then you must remain with that child at all times when in the pool area.
(e) Children in the wading pool (“baby pool”) must be supervised by a parent, guardian or babysitter at all times.
(f) All children who are not “potty trained” and/or children wearing a diaper, must use rubber swim pants over a swim diaper on toddlers or children that may not be completely potty trained. Swim diapers alone are not acceptable! If an infant/child has a fecal accident ("poops") in the pool and he/she is NOT wearing the proper attire as noted, then your membership will immediately be suspended for the ENTIRE pool season. No warnings will be issued for this offense! If a fecal accident occurs, then the pool must be closed down for at least 24 hours to ensure that the pool is properly cleaned. Therefore, there is a "zero tolerance" on this rule!
(g) During the hourly 15-minute “Adult Swim”, all children & youth under the age of 18 years old are required to exit the pool. (This is a great time for parents to ask their children if they need to use the restroom or to change a diaper in the women’s restroom.)
Section 600
Liability & Revocation of Privileges
(a) By entering the pool area, members and guest(s) of members agree to be recorded via a CCTV (camera) system. This system is used to monitor the security and safety of all members and guests.
(b) Lifeguards have the authority to enforce all rules and regulations and to supervise the general conduct of all persons in the pool area. Lifeguards have the full authority to maintain order, reprimand, discipline, restrict and evict any member or guest not complying with the rules and regulations, both written and unwritten.
(c) Additionally, the WCSTA Board of Directors may revoke the right to access any or all of the WCSTA amenities for any WCSTA member (and their household) or their guests if the member or their guest(s) violate any pool rule, or if they engage in any other inappropriate activity, at the sole discretion of the Board of Directors. Members may return to the pool and tennis courts after the board has discussed the situation and voted on appropriate actions to take with the member. Once the suspension has concluded, the key fob(s) of the member household will become active again for use.
(d) Every precaution will be taken for the health and safety of all concerned. However, Westchester Commons Swim & Tennis Association Inc. (WCSTA) and the Board of Directors assume no responsibility. Members or their guests have no claim against the WCSTA or the board of directors for any accident or injury. Westchester Commons Swim & Tennis Association, Inc. and the Board of Directors are not responsible for the loss and damage of personal property.
The WCSTA Board of Directors reserves the right to amend these rules without prior notice to members. Any revisions will be updated on the website and posted on the bulletin board at the entrance to the pool area. It is your responsibility as a member to keep informed of any changes.
